Terms and conditions

Purpose
These terms govern two distinct activities: the design services provided on quotation by Tibo Créteur (Tibz Design), and the sale of downloadable digital products offered in the site's store. The sections below state which apply to each. Any order implies their unreserved acceptance.
Store: digital products
The store sells downloadable digital products, currently the Typix plug-in for Adobe After Effects. Each product page states what the download contains, the supported systems and the supported After Effects versions. Nothing is shipped physically.
Store: price, payment and invoicing
The applicable price is the one shown on the product page and confirmed at checkout, all taxes included. It is a one-time payment, with no subscription, granting lifetime access to the product and its updates. Payment and invoicing are handled by Lemon Squeezy: no card data passes through this site or is stored by Tibz Design.
Store: delivery and waiver of the right of withdrawal
The download link is emailed immediately after payment. Under article L221-28 of the French Consumer Code, since supply of the digital content begins immediately after purchase and with your agreement, you expressly waive your 14-day right of withdrawal on these products. If you hit a download or installation problem, write to contact@tibzdesign.fr: a solution is always looked for.
Store: license of use
The purchase grants a personal, non-exclusive and non-transferable license covering personal and commercial use. The images, videos and renders you produce with the product belong to you. Reselling, publicly sharing and redistributing the file itself are forbidden. The full license text ships with the download and is reproduced on the product page.
Services: quotation and order
Every project is covered by a detailed, free quote stating the scope, deliverables, timeline and price. The order becomes firm once the quote is dated, signed and accepted by the client.
Services: prices and payment
Prices are stated in euros and set per project. Payment terms (any deposit, instalments, payment methods) are specified on the corresponding quote and invoice.
Services: lead times and collaboration
Stated timelines run from acceptance of the quote and receipt of all required materials (copy, visuals, access, brief). Any delay in providing these, or any request outside the agreed scope, shifts the schedule accordingly and may require an amendment.
Services: deliverables and intellectual property
Delivered files and the associated usage rights are transferred to the client only after full payment of the service, within the limits set out in the quote. Unless the client objects in writing, Tibz Design reserves the right to present the work in its portfolio and on its social channels.
Services: right of withdrawal
For a client qualifying as a consumer under French consumer law, a 14-day withdrawal period applies from acceptance of the quote. This right can no longer be exercised once work has started with the client's express agreement before the end of that period. This period applies to services quoted upfront: digital products sold in the store are subject to an express waiver, set out above.
Liability
Tibz Design undertakes to carry out its services with all due care. It cannot be held liable for the use made of deliverables after handover, nor for materials supplied by the client, for which the client warrants it holds the rights.
Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the matter will be brought before the competent courts.
